Workers’ compensation laws pay construction site employees benefits including lost wages and medical expenses. New York State Labor law also provides that site owners, general contractors, and subcontractors follow proper procedures for a safe work environment. The equipment they use, whether it’s ladders, ropes, or scaffolding, also falls under these guidelines.
The following New York laws define duties site owners, contractors, and project foremen or supervisors have to keep construction site equipment safe:
Scaffolding and Other Devices for the Use of Employees – This law requires owners, contractors, or their agents to build and maintain any equipment workers need while they work at heights. This equipment includes scaffolding, ladders, braces, pulleys, and other devices.
The Occupational Safety and Health Administration (OSHA) reports that falls from scaffolding and ladders account for nearly 41 percent of all construction site injuries.
Among the legal requirements, scaffolding or staging more than 20 feet high must have a suitable safety rail attached. The scaffolding must also be able to bear four times the maximum weight listed.
Construction, Excavation, and Demolition Work – New York codes, rules, and regulations require employers not to let workers use safety belts or harnesses that are worn, broken, show signs of mildew or other damage that can affect their strength and safety.
The parties are liable for negligence if they don’t follow reasonable and adequate safety measures. To help you bring them to justice, please note that there are strict time deadlines for personal injury claims.
